Terms & Conditions

BIRDIE HAUS

CUSTOMER TERMS & CONDITIONS

Effective Date: 10/29/26

IMPORTANT: THESE TERMS INCLUDE ASSUMPTION OF RISK, RELEASE OF LIABILITY, INDEMNIFICATION, PAYMENT AUTHORIZATION, AND AUTOMATIC-RENEWAL PROVISIONS.

These Customer Terms & Conditions (the “Terms”) govern memberships, reservations, punch passes, events, guest access, and use of Birdie Haus facilities, golf simulators, equipment, website, booking system, and related services (collectively, the “Services”). By creating an account, purchasing or renewing a membership or pass, making a reservation, entering the facility, or using the Services, you (“Customer,” “Member,” or “you”) agree to these Terms.

1.        ELIGIBILITY, ACCOUNTS & ACCEPTANCE

Customers must provide accurate registration and payment information and keep account information current. Accounts and access credentials are personal and may not be transferred or shared. All customers and players must be at least 18 years old unless accompanied by a parent or adult legal guardian at all times while on the premises. Unaccompanied minors are strictly prohibited in the facility.

Electronic acceptance, including clicking an acceptance box, completing checkout, or using the facility after being presented with these Terms, constitutes agreement to these Terms to the extent permitted by law.

2.        MEMBERSHIPS, PASSES & TERM

Birdie Haus may offer month-to-month memberships, multi-month commitments, annual or prepaid memberships, corporate memberships, limited-session or punch-pass products, leagues, promotions, and other plans. Access tiers are defined by purchase type: 24/7 access is restricted exclusively to customers who maintain an active, recurring monthly membership. Non-members and single-session pass holders may book and access the facility only during standard business hours from 8:00 AM to 10:00 PM. The specific price, including hours or sessions, booking window, guest privileges, discounts, expiration date, and other benefits shown at checkout or in the applicable offer are incorporated into these Terms.

Unless a particular offer states otherwise, prepaid fees, annual fees, initiation fees, and used or expired passes are non-refundable. Limited-session credits and promotional credits expire on the date stated at purchase and have no cash value.

For a fixed-term or multi-month commitment, any early termination fee must be disclosed at purchase. If disclosed for the applicable plan, the customer agrees to pay that fee upon early cancellation, subject to applicable law.

3.        AUTOMATIC RENEWAL & CANCELLATION

Recurring memberships continue for the renewal period disclosed at checkout until canceled in accordance with the cancellation instructions provided by Birdie Haus. Birdie Haus will provide any renewal, price change, or cancellation notices required by applicable law.

A cancellation stops future renewals but does not ordinarily create a refund for a period already paid, except where required by law or expressly stated by Birdie Haus. Cancellation of a membership does not automatically cancel an existing tee-time reservation unless the reservation is separately canceled.

4.        RESERVATIONS & BAY USE

Reservations are for a specific simulator bay and time period. Pricing may vary by day, time, season, membership type, promotion, or location.

A valid payment card may be required to reserve a bay and may be kept on file through Birdie Haus’s payment or booking provider.

Customers must vacate the bay promptly at the end of the reservation so the next reservation can begin on time.

The amount of golf completed during a reservation depends on group size, pace of play, setup time, and other factors. Birdie Haus does not guarantee completion of 9 or 18 holes within any particular reservation length.

Birdie Haus may impose reasonable booking limits, including advance-booking windows, limits on concurrent reservations, or minimum/maximum reservation lengths.

Reservations, bay assignments, and simulator availability may be adjusted when reasonably necessary because of maintenance, equipment issues, safety concerns, private events, or other operational needs.

5.        CANCELLATIONS, LATE ARRIVALS & NO-SHOWS

Unless a different policy is displayed at checkout, reservations should be canceled or rescheduled at least 12 hours before the scheduled start time. A cancellation made with less than 12 hours’ notice may be charged up to the first hour of the reservation or the amount disclosed at booking.

A customer who does not appear for a reservation, or who arrives more than 10 minutes late without notice, may lose the reservation and may be charged up to the full scheduled amount. Birdie Haus may release the bay to another customer after the grace period. No-show, late-cancellation, and event policies displayed at checkout control if they differ from this general policy.

6.        PAYMENTS & PAYMENT AUTHORIZATION

By providing a payment card, you authorize Birdie Haus and its payment processors to charge amounts due for memberships, renewals, reservations, late cancellations, no-shows, merchandise, events, damage charges, and other purchases you authorize. Temporary authorization holds may be used to validate a card.

If a recurring charge is declined, Birdie Haus may suspend access and retry the payment as permitted by its processor and applicable law. You remain responsible for amounts properly due. Any returned-payment or service charge will not exceed the amount disclosed at checkout or permitted by law.

Birdie Haus may use card-account updating services offered by payment networks or processors so that recurring billing can continue when a card is replaced or updated, to the extent permitted by law.

7.        GUESTS

Members may bring guests only to the extent allowed by the member’s plan or reservation. The Member must be present with guests unless Birdie Haus expressly authorizes otherwise. Guests must follow these Terms, posted rules, and any separate waiver requirements.

The Member is responsible for communicating facility rules to guests and may be financially responsible, to the extent permitted by law, for damage caused by the Member or the Member’s guests. Guests under 18 must remain under the continuous direct supervision of an adult Member or legal guardian at all times while on the premises, and the adult Member or guardian assumes full responsibility and liability for their conduct and safety.

8.        ACCESS CREDENTIALS & 24/7 / UNSTAFFED ACCESS

Birdie Haus may operate with automated, keyless, code, app, fob, or link-based entry and may be unstaffed during some or all hours. 24/7 keyless access credentials are provided solely to active monthly members. For non-members, access credentials are programmed and valid strictly during the customer's scheduled reservation within standard business hours (8:00 AM to 10:00 PM). Access credentials are personal and issued to the authorized customer only. Do not share, loan, post, or permit another person to use your credentials.

Birdie Haus will charge an unauthorized access fee of $150 per occurrence to the account holder on file, and may immediately revoke access or terminate membership, for unauthorized credential sharing, tailgating, admitting unauthorized persons, or bypassing security systems. Customers acknowledge that automated or unstaffed access involves risks different from a continuously staffed facility. Customers must familiarize themselves with exits, emergency procedures, posted instructions, and the location of emergency equipment. Emergency exits and safety devices must never be blocked or tampered with.

9.        FACILITY & SIMULATOR RULES

Use golf clubs, balls, tees, mats, screens, launch monitors, computers, televisions, furniture, and other equipment only as intended.

Only one golfer may occupy the hitting area while a swing is being made. All other persons must remain a safe distance behind or outside the hitting zone.

Before swinging, confirm that the hitting area is clear of people, clubs, bags, furniture, food, drinks, and other objects.

Do not intentionally strike balls at walls, ceilings, side netting, cameras, sensors, projectors, monitors, or other equipment.

Use only golf balls and equipment permitted by Birdie Haus. Balls that are damaged, marked in a way that can damage screens, or contaminated with dirt or debris may be prohibited.

No reckless conduct, horseplay, fighting, harassment, threatening behavior, or intentional property damage.

Customers must comply with all posted rules and reasonable instructions from Birdie Haus personnel.

10.     ALCOHOL, SMOKING, VAPING, DRUGS & CONDUCT

Birdie Haus maintains a ZERO-TOLERANCE policy for alcohol, smoking, vaping, and drugs. No alcohol is sold on the premises, and outside alcohol, bring-your-own-beverage (BYOB), smoking, vaping, illegal drugs, and misuse of legal substances are strictly prohibited at all times in any area of the premises, including simulator bays, common areas, restrooms, and exterior parking areas. Customers and guests may not bring, possess, consume, or be under the influence of alcohol or drugs on the property. Violation of this policy is grounds for immediate removal from the premises, suspension or termination of membership (if applicable), and loss of future use privileges, without refund, subject to applicable law.

11.     PROPERTY DAMAGE & CLEANING

Customers are responsible for damage beyond ordinary wear caused by their intentional, reckless, or negligent conduct, or by persons for whom they are responsible, to the extent permitted by law. Birdie Haus may charge the payment method on file for documented repair or replacement of damaged hardware and property (including launch monitors, impact screens, projectors, tracking sensors, computers, and enclosures), extraordinary cleaning, and related third-party service, dispatch, or administrative fees incurred by Birdie Haus, after providing any notice required by law.

12.     ASSUMPTION OF RISK

Golf and golf-simulator activities involve inherent and other risks, including: being struck by a golf ball, club, or detached club head; errant or ricocheting balls rebounding off screens, enclosures, walls, floors, or ceiling hardware; slips, trips, falls, strains, or sudden physical injury; equipment malfunction or power interruption; actions or omissions of other customers or guests; and risks associated with entering, using, or exiting an automated, unstaffed facility without on-site personnel present to provide medical assistance, intervention, or supervision. You voluntarily choose to participate and knowingly assume the ordinary and inherent risks of the activities and premises to the fullest extent permitted by law.

You are responsible for determining whether you are physically able to participate safely and for stopping activity if conditions become unsafe.

13.     RELEASE & LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU RELEASE BIRDIE HAUS AND ITS

OWNERS, AFFILIATES, LANDLORDS, OFFICERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS

FROM CLAIMS FOR PERSONAL INJURY, PROPERTY DAMAGE, LOSS, OR THEFT ARISING FROM THE

ORDINARY RISKS OF USING THE FACILITY OR PARTICIPATING IN GOLF-SIMULATOR ACTIVITIES, AND EXPRESSLY INCLUDING ANY CLAIMS, CAUSES OF ACTION, OR LIABILITIES ARISING OUT OF OR RESULTING FROM BIRDIE HAUS’S OWN ORDINARY NEGLIGENCE (WHETHER ACTIVE OR PASSIVE), TO THE FULLEST EXTENT PERMITTED BY LAW.

This release does not waive liability that cannot legally be waived, including liability for conduct that applicable law does not permit a business to disclaim. Birdie Haus does not guarantee the security of personal property, and customers should not leave valuables unattended.

14.     INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless Birdie Haus and its owners, affiliates, officers, managers, employees, contractors, and agents from third-party claims, losses, or reasonable costs arising out of or resulting from your violation of these Terms, your negligence (including ordinary negligence) or intentional misconduct, your failure to supervise any minor guests, or the acts, omissions, negligence, or property damage caused by you or any of your guests. This provision does not require you to indemnify Birdie Haus for liability that applicable law prohibits Birdie Haus from shifting to a customer.

15.     SUSPENSION OR TERMINATION

Birdie Haus may immediately suspend or terminate access for nonpayment, unauthorized access sharing, safety violations, property damage, unlawful conduct, harassment, fraud, repeated no-shows, violation of posted rules, or other material breach of these Terms. Birdie Haus may also suspend operations or particular services for maintenance, emergencies, or business reasons.

Termination does not eliminate amounts already due. Refunds, if any, will be determined by the applicable membership or reservation terms and applicable law.

16.     CHANGES TO SERVICES, HOURS, PRICING & POLICIES

Birdie Haus may reasonably modify operating hours, equipment, programs, booking rules, membership offerings, or prices. Changes to recurring membership pricing will be communicated before the new price is charged when required by law. Material changes to these Terms will be posted or otherwise communicated as appropriate.

17.     PHOTOGRAPHY, VIDEO & SECURITY CAMERAS

Birdie Haus may use security cameras and access logs for safety, security, fraud prevention, incident investigation, and facility operations. Security cameras record for post-incident review, access verification, and security auditing only; Birdie Haus does not provide live video surveillance, continuous monitoring, or on-site security guard protection. Any use of a customer’s identifiable image or video for advertising or promotional purposes will be handled in accordance with applicable law and any consent obtained by Birdie Haus.

18.     PRIVACY & DATA

Birdie Haus and its service providers may collect information needed to operate the Services, such as name, email address, telephone number, account credentials, reservation history, transaction information, device or usage data, access logs, and security-camera footage. Payment card data may be processed and stored by third-party payment providers rather than directly by Birdie Haus.

Information may be used to provide and maintain the Services, process payments, manage accounts and reservations, communicate with customers, improve operations, protect safety and security, prevent fraud, comply with legal obligations, and enforce agreements. Information may be disclosed to service providers, professional advisers, authorities when legally required, or in connection with a business transaction, subject to applicable law.

Birdie Haus should maintain a separate Privacy Policy describing its current data practices in greater detail. If the Privacy Policy conflicts with this section regarding data practices, the Privacy Policy controls.

19.     THIRD-PARTY TECHNOLOGY

The Services may rely on third-party booking, payment, access-control, simulator, internet, or software providers. Temporary interruptions, outages, maintenance, or third-party failures may occur. Birdie Haus will use reasonable efforts to address operational issues but does not guarantee uninterrupted availability of every feature, course, game, network connection, or simulator function.

20.     INTELLECTUAL PROPERTY

Birdie Haus names, logos, branding, website content, and proprietary materials may not be copied, reproduced, or commercially used without permission. Third-party simulator software, golf courses, games, trademarks, and content remain the property of their respective owners and are subject to applicable licenses and terms.

21.     GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any court proceeding relating to these Terms or the Services shall be brought in a court of competent jurisdiction in the Indiana county where the applicable Birdie Haus facility is located. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR THE FACILITY.

22.     SEVERABILITY; NO WAIVER; ENTIRE AGREEMENT

If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later. These Terms, together with the applicable checkout terms, membership or event offer, posted safety rules, waiver, and Privacy Policy, constitute the agreement governing the applicable Services.

23.     CONTACT

Questions, cancellations, notices, and other communications should be sent using the contact information published by Birdie Haus at birdie-haus.com or through the applicable booking/account portal.
